FORFETTARI – MENO CONTRIBUTI MA SU RICHIESTA



I soggetti che rientrano nel regime forfettario, se voglio sfruttare la riduzione dei contributi INPS, devono, entro il 28 febbraio, presentare la relativa richiesta in via telematica.
Commercianti ed Artigiani che nel 2015 abbracciavano il regime forfettario, potevano (previa richiesta da presentare telematicamente entro il 28 febbraio 2015) pagare i contributi INPS con una sistema simile a quello della “gestione separata” evitando quindi i contributi fissi minimi.
La legge di Stabilità 208/15 però, ha modificato il regime fiscale forfettario e con esso anche il relativo sistema contributivo.
Dal 2016 è possibile godere, previa richiesta, di un sistema contributivo meno costoso ma l’agevolazione:
·        è pari ad una riduzione del 35% dei contributi “classici” di Commercianti ed Artigiani
·        è facoltativa e quindi va richiesta
·        va richiesta online tramite il sito internet dell’INPS
·        va richiesta entro e non oltre il 28 febbraio
·        che ha sostituito la precedente, deve essere chiesta anche dalle persone che avevano richiesto il regime contributivo meno costoso l’anno passato


Per concludere si deve rammentare che, optando per una contribuzione inferiore a quella ordinaria, l’accreditamento dei contributi versati ai fini pensionistici è proporzionalmente ridotto.

FLAT-RATE REGIME – LOW PENSION CONTRIBUTIONS BUT ONLY ON DEMAND

If flat-rate regime people want to obtain the reduction of the INPS contributions, they must present their online request by 28 February .
Traders and craftsmen, who in 2015 embraced the flat-rate regime, could (upon request to be submitted online by 28 February 2015) pay INPS contributions with a similar way to the "separate management" system, thus avoiding the minimum fixed contributions.
Italian Stability law 208/15, however, changed the flat-rate tax system and, with it, the relative contribution system.
In 2016 flat-rate regime people can have, upon request, a less expensive system of contributions but the facility:
·        is equal to a 35% reduction of the "classic" contributions of Merchants and Craftsmen
·        is optional and therefore it must be required
·        is required by an online application in the website of INPS
·        must be requested no later than February 28
·        replaced the previous one
·        must also be claimed by people who had requested the least expensive insurance contribution in the past year

It should be noted that, opting in for a pension contribution that is cheapest than the ordinary one, the accreditation of contributions for pension purposes is proportionally reduced.

novità sulle agevolazioni prima casa


Fino al 31 dicembre 2015, se una persona voleva comprare una abitazione con l’agevolazione “prima casa” non doveva avere:
·        Un’altra casa nello stesso Comune in cui era situata l’abitazione che intendeva comprare con le agevolazioni in oggetto;
·        già acquistato una casa con l’agevolazione “prima casa”
Se “Mario Rossi” avesse voluto comprare un immobile con le agevolazioni prima casa nello stesso Comune in cui aveva già un altro immobile, oppure in altro Comune ma avendo già sfruttato le agevolazioni prima casa, avrebbe dovuto vendere l’immobile, già di proprietà, prima dell’acquisto desiderato.
Con la legge di Stabilità 208/2015, dal 2016, nel caso in cui una persona voglia comprare un’abitazione con le agevolazioni prima casa avendole però già sfruttate, lo potrà fare ma solo a condizione che entro un anno dal (ri)acquisto dell’immobile con le agevolazioni “prima casa” rivenda l’immobile precedentemente comprato con l’agevolazione citata.
Nel caso in cui l’impedimento all’agevolazione sia invece la possidenza di un altro immobile nello stesso Comune, non ci sono cambiamenti nella norma e quindi l’unica soluzione era e rimane quella di vendere l’immobile prima dell’acquisto “agevolato” della casa.
Durante Telefisco 2016 è stato chiarito che la nuova norma si applica agli acquisti di immobili posti in essere dal 1 gennaio 2016.
Non è possibile quindi ad esempio:
·        aver acquistato un immobile in data 1/10/2015 senza agevolazione prima casa perché già sfruttata
·        rivendere l’immobile acquistato con le agevolazioni prima casa entro un anno dall’acquisto del “secondo” immobile e poi

·        chiedere il rimborso delle imposte pagate in sede di acquisto della “seconda” casa eccedenti quelle che si sarebbero pagate se si fosse potuto comprarla con le agevolazioni prima casa.

Until 31 December 2015 (in Italy), if a person wanted to buy a house, with "first home" facilitation,  he didn’t have to own:
• Another house in the same municipality where he wanted to buy the new house with the mentioned facilities;
• a house bought with facilitation "first house".
If "John Smith" wanted to buy a property with the first house benefit in the same municipality where he had another property, or in another municipality but having already taken the advantage of the first house, he had to sell the property, formerly owned, before the desired purchase.
With the law of stability number 208/2015, from 2016, when a person wants to buy a house with the first house facilitation having already had it, he can do it only on the condition that, within a year from the repurchase of the property with the "first home" facilitation, he (or she) resells the property previously bought with the indicated benefit.
In case in which the impediment to facilitation is the ownership of another property in the same municipality, there are no changes in the law and so the only solution was and is to sell the property before the "facilitated" purchase  of the house.
During “Telefisco 2016” it was clarified that the new rules apply to property purchases in place by January 1, 2016.
It is not therefore possible for example:
• purchasing a property on 10.01.2015 without Facilitation first house because already used
• sell the property bought with the first house facilitation within one year from the "second" property purchase and then

• ask for a refund of taxes paid on the purchase of "second" home that exceed those that would have paid if he had been able to buy with the first house facilitation.
