CONSENT TO PRACTITIONERS, PSYCHOLOGISTS ETC .. TO SEND THE STS DATA


From 14th  November (2016) who goes to a nurse, radiologist, psychologist, midwife, veterinarian, para-pharmacy or to an optical, may request that the healthcare costs paid are not communicated to the Revenue Agency (communication due to send for the  "precompiled" tax return – partially precompiled tax return).
The "No" can be immediately noted on the receipt or invoice that the professional must issue.
For the invoices or receipts released before 14th November,  the taxpayers must ask the National Card System (STS) or the Revenue Agency for their own costs are not included in the precompilated tax return.
The new precompiled model 730 will therefore theoretically more complete as the costs of visits of nurses, radiologists, psychologists, obstetricians, veterinarians, pharmacies and opticians will be included, as well as the costs of pharmacies and physicians.
These new ‘subjects’ will have to pay close attention to the date of 14th November 2016 because all the data of the year 2016, prior to this date, will have to be mandatorily sent and the data from 14th November onwards will have to be sent only if authorized by the client / patient.
For the sake of completeness, it must be added that the same bond was triggered at the end of September for the private health facilities.
Nothing changes for physicians because since last year they didn’t have to send data to the STS if the patient had asked him for it.

In the light of the sensitivity of the issue, consider for example the psychologists, It’s very advised: first of all to say it personally, second of all to display a sign at the entrance to inform customers of the new requirement.

QUANDO LA CASA E’ ANCHE STUDIO O AZIENDA


I professionisti e gli imprenditori individuali che utilizzano la propria abitazione anche come sede della propria attività posso dedurre e detrarre i servizi e le utenze “domestiche” se acquistate con la propria partita iva.
La deduzione del costo e la detrazione dell’IVA però è parziale.
Locazione
i costi di locazione dell’appartamento utilizzato promiscuamente dall’imprenditore individuale o dal professionista sono deducibili al 50% a condizione che il titolare di partita iva non disponga di altri immobili (ovunque nel caso dell’imprenditore individuale e nel medesimo comune nel caso del professionista) adibiti esclusivamente all’esercizio d’impresa arte o professione
L’eventuale IVA per la locazione dell’immobile non può invece essere in ogni caso detratta.
Utenze
i costi, ora considerati, sostenuti dai professionisti posso essere dedotti al 50% a prescindere dai metri quadrati utilizzati effettivamente per l’attività professionale. Il limite del 50% non può essere variato anche se il professionista riuscisse a dimostrare che la percentuale di abitazione utilizzata per l’attività professionale è maggiore del 50% (circolare 35/E/2012, paragrafo 2.2)
Non è invece possibile dedurre il costo se il professionista dispone nello stesso Comune di un altro immobile adibito esclusivamente all’esercizio dell’arte o professione (Art. 54, co. 3 DPR 917/82).
I costi, ora considerati, sostenuti dagli imprenditori individuali non sono invece considerati nel Tuir.
In base ad una vecchia circolare del 1975 (la n. 9/50091), ad esempio, le spese di riscaldamento degli immobili adibiti ad abitazione ed a sede dell’attività possono essere dedotti per la parte inerente la sfera commerciale con una ripartizione proporzionale in base ad elementi certi e obiettivamente comprovanti (non quindi con una percentuale a forfait come per i professionisti).
La detrazione dell’Iva sulle utenze in questione non trova invece differenze tra professionisti e imprenditori individuali.
Per determinare la percentuale di detraibilità dell’Iva si deveno utilizzare criteri oggettivi e coerenti come ad esempio la cubatura dei locali; se, ad esempio, il 30% viene utilizzato per l’attività allora la percentuale di detraibilità Iva sarà il 30% (circolare 24/12/2007, n. 328, paragrafo 3.2).

Da aggiungere infine che per poter dedurre il costo e detrarre l’Iva (meglio dire una parte del costo e dell’Iva) non può essere richiesta la fornitura del servizio ad uso domestico con iva al 10%. Si deve richiedere la fornitura con Iva al 22% in quanto l’aliquota Iva al 10% presuppone l’esclusivo uso domestico dell’utenza.

WHEN YOUR HOUSE IS ALSO HEADQUARTER


The professionals and the sole traders who use their house also as place of business can deduct their "home" utilities and services if they are purchased with their own VAT.
The deduction of the cost, and the deduction of VAT, however, is partial.
House renting
the rental costs of the flat used promiscuously by the sole trader or the professional are deductible at 50% if the VAT number owner has not other properties (anywhere in the sole trader’s case and in the same town in the case of professional) exclusively used for his business.
Any Vat tax paid for the lease can not ever be deducted.
Utilities
The costs, now considered, beared by professionals can be deducted at 50% regardless the real square meters used for the professional activity. The 50% limit can not be changed even if the professional can demonstrate that the percentage of the used professional activity house is greater than 50% (Circular 35 / E / 2012, paragraph 2.2)
The cost is not deductebleif the professional has in the same Municipality another property exclusively used for his business (Art. 54, par. 3 of DPR 917/82).
The costs, now considered, bearded by sole traders are not considered in the TUIR.
According to an old circular of 1975 (n. 9/50091), for example, the warming costs of buildings used as house and also for business can be deducted for the part concerning the buniness sphere with a proportional allocation based in sure and objective ‘cornerstones’ (so not with a flat rate like the percentage used by professionals).
The deduction of the VAT for the utilities now considered does not find instead differences between sole traders and professionals.
To fix the VAT deductible percentage we must useobjective and consistent criteria such as the building volume; if, for example, 30% is used for the business activity then the VAT deducteble percentage will be 30% (circular 24/12/2007, n. 328, paragraph 3.2).

Now I have to add that in order to deduct the cost and the VAT (actually It’s better to say a part of the cost and VAT) can not be required thedomestic service supply with 10% VAT. The correct VAT percentage is only the 22% because the 10% VAT percentage assumes the exclusive domestic use.

STUDI DI SETTORE ADDIO! SARA’ VERO?


Probabilmente con la prossima legge di stabilità gli studi di settore non dovranno più essere compilati. Questa è sicuramente una bella notizia, il problema è che subito dopo appariranno gli “indicatori di normalità”. La domanda nasce spontanea: “ cambieranno nome e vestito ad una parte della dichiarazione senza di fatto cambiare nulla?”
L’agenzia delle Entrate eliminerà gli studi di settore per usare uno strumento che misurerà, secondo Sose ed Agenzia delle Entrate, il grado di affidabilità dei contribuenti titolari di partita iva.
A quanto pare, gli indicatori di normalità avranno come punto di riferimento per la determinazione dell’indice: i ricavi, che si potranno adeguare in sede di dichiarazione dei redditi, ed altri elementi (qui le informazioni sono generiche). Beh! In effetti gli studi di settore sono diversi… anzi no!
La vera novità, probabilmente, sarà nella base e nel medoto di calcolo di questo benedetto indice; vera novità percepita. Infatti, il programma non dirà il ricavo minimo ma darà un voto, da 0 a 10, al titolare di partita iva definendolo contribuente affidabile o non affidabile.
Tornando al sistema di determinazione dell’affidabilità del contribuente sembra che, ad esempio:
·        non si guarderanno solo i ricavi ma anche il valore aggiunto e il reddito d’impresa
·        i calcoli statistici avranno come base di riferimento 8 anni invece che 1
·        saranno richiesti meno dati (e questo sarà veramente utile a descrivere l’affidabilità?)
·        ci sarà una nuova funzione logaritmica per calcolare il valore aggiunto per addetto
·        l’agenzia delle entrate comunicherà al contribuente il “risultato di affidabilità” (nel senso che lo dice dopo che si è inviata la dichiarazione dei redditi oppure al termine della compilazione della dichiarazione come avviene ora per gli studi di settore?)

se questo cambiamento sarà veramente positivo (per il contribuente) è presto per dirlo certo è che anche qui nasce una nuova domanda: sostituiscono gli studi di settore con gli indici di affidabilità perché gli studi di settore non rappresentavano la realtà oppure perché diverse sentenze toglievano potere agli studi di settore?

SECTOR TESTS GOODBYE! IS IT TRUE?


Probably with the next stability law the sector tests will no longer be filled. This is definitely a good news, the problem is that we’ll have to face the "reliability indicators" (or compliance rating). A question arises: "will Revenue Agency change name and dress of a part of the Tax return without actually changing anything?"
The Revenue Agency will remove the sector test to use a tool that will rate, according to S.O.S.E. and Revenue Agency, the degree of reliability of the VAT-holder taxpayers.
Apparently, the reliability indicators will have as a benchmark for the rate determination: revenues, and you can adjust them in the tax return, and other elements (about this the information is generic). Well! The sector test is different ... no, It isn’t!
The real news will probably lay on the base and on the calculation method of this ‘blessed’ indicator/rate. In fact, the program won’t tell you the minimum revenue, but It will give a rating, from 0 to 10, to the VAT holder saying if he/she is a reliable or unreliable payer.
Getting back to the determination of the reliability of the taxpayer, It seems that, for example:
• the program doesn’t look only revenues but also the added value and business income
• statistical calculations will have as reference time 8 years instead of 1
• Less data will be required (will this be really useful to describe the reliability?)
• There will be a new logarithmic function to calculate the added value per worker
• Revenue Agency will notify the taxpayer the "reliability result" (is It meaning that it says the result after you have submitted your tax return or at the end of completing the return as it does now for the sector tests?)

It’s too early to say whether this change will be very positive (to the taxpayer), for sure a new question arises again: do they replace the sector test with the reliability indicator because the sector test did not represent reality or because many sentences took away power to sector test?

SCOMPORRE IL CONTRATTO DI APPALTO


Per poter applicare in modo corretto il meccanismo del reverse charge nel settore edile, in alcuni casi, può essere utile scomporre il singolo contratto per superare alcuni problemi legati alle prestazioni di servizi di pulizia, demolizione, installazione di impianti e completamento di edifici.
Secondo le istruzioni fornite dall’Agenzia delle Entrate con le circolari 14/E e 37/E del 2015, per applicare correttamente il meccanismo del reverse charge in edilizia si deve verificare:
·        L’eventuale scomposizione dell’intervento realizzato dal prestatore
·        La corretta individuazione delle singole prestazioni coinvolte attraverso i codici Ateco 2007 (individuati nella circolare 14/E del 2015)
In riferimento ai codici Ateco individuati si posso citare ad esempio:
·        Il codice 43.21.01: Installazione di impianti elettrici in edifici o in altre opere di costruzione (inclusa manutenzione e riparazione)
·        Il codice 43.21.02: Installazione di impianti elettronici (inclusa manutenzione e riparazione)
Si deve precisare che le prestazioni ex art 17 co 6 lettera a-ter del DPR 633/72 soggiaciono al regime dell’inversione contabile indipendentemente dal rapporto contrattuale stipulato e dalla tipoligia di attività esercitata. Per queste fattispecie si deve verificare la singola prestazione rientrante nel contratto.
Siccome, ad esempio, in un contratto di manutenzione straordinaria di un edificio non si ha un’unica attività Ateco di “manutenzione straordinaria” ma si hanno diverse attività che assieme vanno a costituire la manutenzione straordinaria (es. manutenzione di impianto elettrico, sostituzione di infissi ecc..) si deve scomporre il contratto in tutta una serie di “sotto contratti” in modo da definire i diversi tipi di attività che lo vanno a comporre. Per ogni tipo di “sotto attività” si deve quindi verificare se esistono o meno i presupposti per l’inversione contabile o per il regime normale.
Se la scomposizione, sempre secondo le circolari citate, dovesse risultare difficoltosa per la presenza di un unico contratto di appalto, in questo caso si dovrebbe applicare a tutte le operazioni solo ed esclusivamente il regime iva ordinario e quindi anche a quelle che teoricamente avrebbero (se si fosse potuto definirle correttamente)  dovuto soggiacere al regime dell’inversione contabile.
La complessità del contratto è riconosciuta nei casi di:
1.     Contratto unico di appalto avente per oggetto:
a.      la costruzione di un edificio
b.     interventi di restauro e di risanamento conservativo

2.     prestazioni soggette a reverse charge per interventi edilizi di frazionamento o accorpamento dell’unità immobiliare di cui all’art 3 co. 1 lettera b) del DPR 380/2001 (interventi che ora ricadono tra le manutenzioni straordinarie)

DECOMPOSING THE CONTRACT FOR REVERSE CHARGE REGIME


In order to correctly apply the reverse charge regime in the construction industry, in some cases, it may be useful to decompose the individual contract to overcome certain problems related to the provision of cleaning services, demolition, equipment installation and building completion.
According to the instructions provided by the Revenue Agency with the circular 14/E and 37/E of 2015, in order to correctly apply the reverse charge regime in the building must be checked:
• The eventual splitting of the operation made by the provider
• Proper identification of the individual services involved through 2007 Ateco codes (identified in Circular 14/E 2015)
With reference to the identified Ateco codes we can quote for example:
• The code 43.21.01: Electrical installation in buildings or other construction projects (including maintenance and repair)
• The code 43.21.02: Installation of electronic systems (including maintenance and repair)
It should be noted that the performance under the article 17 par. 6 letter a-ter of DPR 633/72 underlie to the reverse charge regime regardless of the contractual relationship entered into and of the type of business pursued. For these cases you have to check the individual services included in the contract.
As, for example, in an extraordinary maintenance contract of a building you do not have a single Ateco code for "extraordinary maintenance" activity but you have different activities which, together, make up the extraordinary maintenance (e.g. An electrical system maintenance, replacement of fixtures etc ..) you have to decompose the contract in a number of ‘sub-contracts’ in order to define the different types of activities that go to make it up. For each type of these ‘sub-activities’ you have to ascertain whether or not there are the conditions for the reverse charge or the normal regime.
If the decomposition, according to the mentioned circular, becomes difficult for the presence of a single contract, in this case it should apply to all activities only and exclusively the ordinary VAT scheme and therefore also to those activities that theoretically would (if it had been able to define them correctly) had to be under the reverse charge regime.
The complexity of the contract is recognized in the cases of:
1.     Unique Agreement contract covering:
a.      the construction of a building
b.     restoration and conservative renewal

2.     services under the reverse charge regime for building fractionation operations or property unit merging under Article 3 par. 1 letter b) of Presidential Decree 380/2001 (interventions that now are included in the extraordinary maintenance)
